Process Service & Document Filing Basics
Filing Court Documents To Initiate Legal Process & Process Service Options
Go to your local courthouse and get the necessary paperwork from the clerk
We will be referring to small claims courts and civil courts. Check on laws and amount caps of claim to determine your court. Small claims court does not involve attorneys.
You can get Ca court action documents from the http:/ca.gov website for the specific courts and forms needing filing.
If you are involved in a civil lawsuit, you may have your attorney handle all paperwork & documents or you can also do so without an attorney. Both forms of court action involve pre notification of party or defendant involved to respond before filing further legal action.
Once proceeding with action, you will need to file documents with the court to arrange a hearing at some point. Once you have filed the necessary papers with the court and have been assigned a court date and location, you will need to send copies of these documents to the party being sued/defendant. The delivery of documents, called process service, is the legal method employed to notify the defendant. You must follow certain legal rules for process service of documents. Not following legal process service procedures can nullify your court date hearing and be potentially costly.
You cannot personally do process service to the party you are suing. You must get a third party to do so. It can be anyone you know not involved in the lawsuit of legal age.

- Marshall’s Dept.
